These Terms of Service describe the rules that apply to your use of the Frontier Foundry website. They are written to be readable. Where formal contractual obligations apply — for example, during a paid engagement — those agreements are negotiated separately and govern the relationship.
Agreement to terms
These Terms of Service govern your access to and use of frontierfoundry.com and the marketing materials, documentation, and forms made available through it (the "Site"). By accessing the Site you agree to these Terms.
Your use of the Frontier Foundry platform itself — including Limni, Kundi, and any Foundry Lab engagement — is governed by a separate written agreement between Frontier Foundry and the contracting organization. Where the contractual agreement and these Terms conflict in the context of a paid engagement, the contractual agreement controls.
Eligibility
The Site is intended for use by individuals acting on behalf of an organization evaluating or partnering with Frontier Foundry. By using the Site you represent that you are at least 18 years old and that you are authorized to act on behalf of the organization you reference.
Use of the site
You agree to use the Site only for lawful purposes. You will not attempt to interfere with the Site's normal operation, probe it for vulnerabilities outside of an authorized program, scrape it at a rate intended to disrupt service, or use it to send unsolicited communications.
We may suspend or revoke access to the Site at any time and for any reason, including suspected violation of these Terms.
Intellectual property
The Site, including its content, layout, code, and trademarks, is owned by Frontier Foundry or its licensors and is protected by copyright, trademark, and other applicable laws. You may view and print pages for your internal evaluation but may not republish, redistribute, or commercially exploit the Site without our prior written consent.
Frontier Foundry, Limni, Kundi, Foundry Lab, and the Frontier Foundry logo are trademarks of Frontier Foundry. All other marks belong to their respective owners.
Submissions and feedback
If you submit a question, idea, or other feedback to us through the Site or by email, you grant Frontier Foundry a non-exclusive, royalty-free, worldwide license to use that feedback to improve our products and services. We will not publicly attribute feedback to you without your consent.
Confidentiality
Information disclosed during a prospective engagement — for example, scoping conversations, draft proposals, and pre-contract diligence — is treated as confidential under the terms of any non-disclosure agreement signed by both parties. This Site itself is not a substitute for that agreement.
Third-party links and services
The Site may link to third-party resources, including our Substack publication. Frontier Foundry is not responsible for the content, policies, or practices of any third-party site or service. Your use of those resources is subject to their own terms.
Disclaimers
The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Frontier Foundry disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, and non-infringement.
Nothing on the Site constitutes legal, regulatory, financial, medical, or other professional advice. You should not rely on Site content as the sole basis for any decision affecting your organization.
Limitation of liability
To the maximum extent permitted by applicable law, Frontier Foundry will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Site.
Frontier Foundry's aggregate liability for any claim arising out of the Site will not exceed one hundred U.S. dollars (USD $100). These limitations do not apply to liability that cannot be excluded under applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless Frontier Foundry and its officers, employees, and contractors from any claim, demand, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws provisions. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
Changes to these terms
We may update these Terms from time to time. The most current version is always posted at this URL. Material changes will be reflected in the "Last updated" date above. Your continued use of the Site following changes constitutes acceptance of the updated Terms.
